1. Acceptance of these Terms

By creating an account, taking the quiz, purchasing a subscription, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Subscription Policy. If you do not agree, please do not use the Service.

2. Who can use FeelChosen

FeelChosen is designed for adult women (18 years or older) in a committed relationship who want to explore their emotional connection with their partner. You confirm that you are at least 18 years old and that you have the legal capacity to enter into these Terms.

3. What FeelChosen is — and what it is not

The Service provides educational, self-guided content: a quiz, a personalised daily practice, written reflections, PDFs, and gentle rituals inspired by relationship research and attachment theory.

FeelChosen is not therapy, counselling, coaching, medical or mental-health treatment, or any form of professional advice. It is not a substitute for care from a licensed therapist, physician, or other qualified professional. If you are experiencing distress, abuse, or crisis, please reach out to a qualified professional or your local emergency services immediately.

4. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us at support@ever-songs.com immediately if you suspect any unauthorised use. We may suspend or terminate accounts that violate these Terms, appear fraudulent, or are used in a way that harms other users or the Service.

5. Subscriptions, billing and auto-renewal

Paid access to FeelChosen is sold as an auto-renewing subscription (Monthly plan or New Member Deal). By purchasing, you authorise us and our payment processor (Stripe) to charge your payment method for the initial term and for each renewal term at the then-current price, until you cancel. Full details, including cancellation and refund rules, are set out in our Subscription Policy, which forms part of these Terms.

6. Coupons, promotions and discounts

Promotional prices, discount codes and introductory offers are valid only for the periods and conditions stated. They are non-transferable, have no cash value, cannot be combined unless we say so, and may be withdrawn or modified at any time. Renewal charges after a promotional period will be at the standard price disclosed at checkout.

7. Licence to use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Service for your own, personal, non-commercial use.

8. Intellectual property

All content, software, designs, text, graphics, audio, video, PDFs, plans, brand assets, and other materials made available through the Service (the “Content”) are owned by or licensed to Dr.Mood Inc. and are protected by copyright, trademark and other laws. Except as expressly permitted, you may not copy, modify, distribute, sell, publish, publicly display, reverse-engineer, scrape or create derivative works based on the Content.

9. User content and reflections

You may enter personal reflections, journal entries, quiz answers or other information into the Service (“User Content”). You retain ownership of your User Content. You grant us a limited, worldwide, royalty-free licence to store, process and display your User Content solely to operate and improve the Service for you. We will not publish or share your User Content publicly.

10. Acceptable use

You agree that you will not:

• use the Service in any unlawful, harmful or abusive way;
• use it on behalf of someone else without their informed consent;
• share, resell or transfer your account or plan;
• attempt to bypass paywalls, coupons, rate limits or security controls;
• upload malicious code, or interfere with the operation of the Service;
• use the Service to harass, threaten, stalk or manipulate another person, including your partner.

11. Third-party services

The Service uses third-party providers, including Stripe (payments), Resend (transactional email), Twilio (WhatsApp / SMS), Supabase (hosting and database) and analytics tools. Your use of the Service is also subject to their applicable terms and privacy policies. We are not responsible for the practices of these third parties.

12. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, error-free, or produce any particular outcome in your relationship or emotional wellbeing.

Any decision you take based on the Service is your own. The Service does not guarantee any specific result, including changes in your partner's behaviour, feelings, or the state of your relationship.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Dr.Mood Inc., its affiliates, directors, employees or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, relationships, data, goodwill or other intangible losses, arising from or related to your use of the Service. Our total aggregate liability under these Terms shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD 50.

14. Indemnity

You agree to indemnify and hold harmless Dr.Mood Inc. and its team from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

15. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnity, governing law) will continue to apply.

16. Changes to the Service and Terms

We may update the Service and these Terms from time to time. If we make material changes we will let you know by email or in-app notice. Continued use of the Service after the changes take effect means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Dr.Mood Inc. is established, without regard to conflict of law rules. You and we agree to try in good faith to resolve any dispute informally by contacting support@ever-songs.com first. If a dispute cannot be resolved, it shall be brought in the competent courts of that jurisdiction, unless mandatory local law gives you the right to bring it elsewhere.
